NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS April 30, 2020 County of Hawai`i Office of Housing and Community Development 1990 Kino`ole Street, Suite 102 Hilo, Hawai`i 96720 (808) 959-4642 These notices shall satisfy two separate but related procedural requirements. REQUEST FOR RELEASE OF FUNDS On or about May 28, 2020, the County of Hawai`i’s Office of Housing and Community Development will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of the 2020 Community Development Block Grant (CDBG) program funds under Title 1 of the Housing and Community Development Act of 1974, as amended, to undertake a project known as the Residential Repair Program, for the purpose of repairing single family residences in the County of Hawai`i. FINDING OF NO SIGNIFICANT IMPACT The County of Hawai`i has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act (NEPA) of 1969 is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the County of Hawai`i’s Office of Housing and Community Development, 1990 Kino`ole Street, Suite 102, Hilo, Hawai`i or 74-5044 Ane Keokolalole Highway Building B, 2nd Floor, Kailua-Kona, Hawai`i and may be examined or copied weekdays 7:45a.m. to 4:30p.m.except holidays. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the County of Hawai`i’s Office of Housing and Community Development, 1990 Kino`ole Street, Suite 102, Hilo Hawai`i 96720. All comments must be received by May 14, 2020 and will be considered by the County of Hawai`i prior to authorizing submission of a request for release of funds. Commenters should specify which part of this Notice they are addressing. ENVIRONMENTAL CERTIFICATION The County of Hawaii certifies to HUD that Harry Kim, in his capacity as Mayor, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Office of Housing and Community Development to use program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will consider objections to its release of funds and the County of Hawai`i’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the County of Hawai`i approved by HUD; (b) the County of Hawaii has omitted a step or failed to make a determination or finding required by HUD regulations at 24 CFR part 58 (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; (d) another Federal, State or local agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Mark A. Potential objectors should contact HUD at (808) 457-4662 to verify the actual last day of the objection period.
