NOTICE OF POSTPONED FORECLOSURE SALE 64-5281 Nuuanu Street, Kamuela, HI 96743 TMK: (3) 6-4-010-008 Notice is hereby given that pursuant to the “Findings of Fact, Conclusions of Law and Order Granting Plaintiff Homestreet Bank’s Motion for Summary Judgment and Interlocutory Decree of Foreclosure, Filed August 24, 2017,” filed November 7, 2017 in Civil No. 17-1-134K, in the Circuit Court of the Third Circuit, State of Hawai`i, the undersigned Commissioner has been appointed to sell the property described herein at public auction as follows: PROPERTY DESCRIPTION: Three bedroom, two bathroom, single-family dwelling. OPEN FOR INSPECTION: Not Applicable per “Order on Commissioner’s Motion for Instructions Filed August 14, 2019,” filed October 11, 2019. NEW AUCTION DATE: Friday, July 31, 2020, noon, at the flagpole at Hale Halawai, Ali`i Drive, Kailua-Kona, Hawai`i. TERMS OF SALE: No upset price. Property to be sold “AS IS” to the highest bidder at public auction by way of quitclaim conveyance with no representations or warranties as to title or possession. Not less than ten percent (10%) of the highest successful bid price in cash, certified check, or cashiers check shall be deposited with the Commissioner immediately upon the close of auction, except Plaintiff may satisfy the down payment by way of offset up to the amount of its secured debt. Down payment is subject to forfeiture in whole or in part for failure to close the purchase as ordered by the court. Potential bidders must prove their ability to comply with 10% bid requirement prior to participating in the public auction. The balance of said purchase price is payable in cash, or by a certified or cashier’s check, concurrent with delivery of documents transferring title to the property to the buyer, except payment by Plaintiff shall be made by offset against the amount of its secured debt. The sale is subject to confirmation by the Third Circuit Court. Buyer is responsible for securing possession of the property and all costs thereof, as well as all costs of closing, including but not limited to costs of conveyance, escrow, closing fees, conveyance documents, recording fees, notary fees, consent fees, conveyance taxes, proof of title, and title insurance. Commissioner may require that the sale close through an escrow, even if the Buyer does not require one.
