NOTICE OF POSTPONED FORECLOSURE SALE 75-5919 Alii Drive, Apt # A-3, Kailua-Kona, HI 96740 TMK # (3) 7-5-018-008 (CPR 0003) An unfurnished 2 bedroom, 2 bath one-story apartment unit being Apartment A-3 of the “ALII COVE” Condominium Project (“Project”) as described in Declaration of Condominium Property Regime dated November 17, 2003, recorded in the Bureau of Conveyances of the State of Hawaii as Document No. 2003-264231 (“Declaration”), as may be further amended from time to time, and as shown on the plans for the Project filed as Condominium Map No. 3678, as the same may be amended from time to time. Notice is hereby given that pursuant to the Findings of Fact and Conclusions of Law and Order Granting Plaintiff’s Motion for Default Judgment Against Robert De Campo and Summary Judgment and Decree of Foreclosure Against All Defendants on Complaint Filed April 25, 2018; Exhibit A, in HSBC Bank USA, National Association as Trustee for Wells Fargo Asset Securities Corportation, Mortgage Asset-Backed Pass-Through Certificates Series 2007-PA2 vs. Robert De Campo, et al.; Civil No. 18-1-0083K (Foreclosure), in the Circuit Court of the Third Circuit, State of Hawaii, the below-named Commissioner has been appointed to sell the abovedescribed property at public auction as follows: Open House: There will be no further open houses. Auction: Monday, August 9, 2021 12:00 p.m. At the flag pole fronting Hale Halawai, Kailua-Kona, Hawaii. TERMS OF SALE: Property is to be sold “AS IS,” without any representations or warranties whatsoever as to title or possession and by way of a quitclaim conveyance by public commissioner’s sale, to the highest bidder with no upset price. The successful bidder at the sale shall make a down payment to the Commissioner in an amount not less than ten percent (10%) of the highest successful bid price. This payment shall be in cash, money order, by cashier’s check, or by certified check, provided that Plaintiff may satisfy the down payment by way of offset up to the amount of its secured debt. Prior to bidding, any person not authorized to credit bid must show the Commissioner such person’s present ability to make the required down payment in such form immediately upon the close of bidding. At the Court’s discretion, the down payment may be forfeited in whole or in part if the purchaser shall fail to pay the balance of the purchase price as hereinafter set forth. In no event shall the purchaser be liable for damages greater than the forfeiture of the down payment. The balance of the purchase price shall be paid to the Commissioner upon approval and confirmation of the sale. The Commissioner may require that the sale close through an escrow, even if the purchaser does not require one. All costs and expenses of closing, including, but not limited to, the costs of conveyance, including preparation of the conveyance document, conveyance tax, escrow fees, recording fees, any proof of title, title insurance, notary fees, and the costs of any necessary eviction and securing possession of the mortgaged property at recordation shall be the responsibility of and paid by the purchaser. The purchaser is responsible for evicting any occupant, if necessary, and securing possession of the mortgaged property at closing.
