NOTICE OF PUBLIC HEARING

Pursuant to Sections 91-2 and 92-41, Hawaii Revised Statutes (HRS), the Hawaii Public Housing Authority (HPHA), Department of Human Services (DHS), hereby provides notice that it will hold a public hearing on the following administrative rule changes:
1) Repeal Chapter 15-186, “State-Aided Elderly Public Housing Projects,” Hawaii Administrative Rules (HAR), and adopt Chapter 17-2035, “State-Aided Elderly Public Housing Projects,” HAR; and
2) Repeal Chapter 15-193, “State-Aided Family Public Housing Projects,” Hawaii Administrative Rules (HAR), and adopt Chapter 17-2034, “State-Aided Family Public Housing Projects,” HAR.

Background: The purpose of these amendments are to move the HAR chapters for the State Elderly and State Family public housing programs from Title 15, which is reserved for the Department of Business, Economic Development, and Tourism (DBEDT), to Title 17, which is reserved for DHS. Act 196, Session Laws of Hawaii (SLH) 2005, separated the housing financing and development functions from the Housing and Community Development Corporation of Hawaii. This resulted in the creation of the Hawaii Housing Finance Development Corporation, which was administratively attached to DBEDT, and the HPHA, which was administratively attached to DHS. Since the effectuation of Act 196, SLH 2005, the HPHA has continued to manage both State public housing programs in accordance with Chapters 15-186 and 15-193, HAR. All proposed amendments are technical and non-substantive in nature.

Public Review: The draft administrative rules are available for public viewing at the HPHA’s School Street Campus and its site management offices on weekdays between 7:45 a.m. to 4:30 p.m.

All interested persons are invited to provide oral or written comments on the draft administrative rules. All comments received will be considered and incorporated appropriately into the drafts. Oral comments may be presented during the public hearing. Persons who cannot attend the hearing and prefer not to provide written comments may call (808) 436-7183 to submit their comments as a voicemail message.

Written comments may be presented to the presiding officer at the public hearing, or mailed to the HPHA, Attention: State Public Housing Administrative Rules, at 1002 North School Street, Honolulu, Hawaii 96817. Written comments may also be faxed to (808) 832-4679 or sent by electronic mail to hpha@hawaii.gov. Written comments not presented at the public hearing should be received by the HPHA’s Administrative Office by 4:30 p.m. on January 2, 2024.
