Civil No. 3CCV-23-0000200 Agency Appeal PL-BOA-2022-00020 and PL-BOA-2022-00021 SUMMONS AND NOTICE TO: BEATA ZANONE YOU ARE HEREBY NOTIFIED THAT the Appellants-Appellants Lawrence Ford, John Koontz, Don Davis, Phillip Koszarek, William Robert Gage and Rebecca S. Gage filed an agency appeal in Civil No. 3CCV-23-00 00200 in the Circuit Court of the Third Judicial Circuit, Kona Division in which they ask the court to vacate and to reverse the decision of the County of Hawaii Board of Appeals that was entered by the Board of Appeals in the agency cases noted. The property affected by the agency appeal is located in Kaawaloa, South Kona, County and State of Hawaii and is designated for property tax purposes as Tax Map Key (3) 8-1-009-044, 81-905 Makahiki Lane, Captain Cook, Hawaii. In accordance with Rule 72, Hawaii Rules of Civil Procedure, the Appellants-Appellants are required to serve you with designated pleadings and you have the right to file a counterdesignation of the record on appeal, to file an answer or motion in response to the Appellants-Appellants’ statement of the case and to file an Answering Brief to the Appellants-Appellants’ Opening Brief filed on July, 24, 2023. YOU ARE HEREBY SUMMONED to appear in the courtroom of the Honorable Wendy Deweese at the Keahuolu Courthouse at 74-5451 Kamaka’eha Avenue, Kailua-Kona, Hawaii 96740 on the 10th day of April, 2024 at the time of 8:00 o’clock a.m. and to inform the Court whether you intend to file a counterdesignation of the record on appeal, an answer or motion to the Appellants-Appellants’ statement of the case and to file an Answering Brief in response to the Appellants-Appellants’ Opening Brief, filed herein on July 24, 2023 within the time provided by Rule 72, Hawaii Rules of Civil Procedure. IF YOU FAIL TO DO SO, you will deemed to have waived your right to file a counterdesignation of the record on appeal, to file an answer or motion to the Appellants-Appellants’ statement of the case and to file an Answering Brief; and, further, the Court may proceed with the disposition of the agency appeal, including oral arguments, without your participation and may, if the Court deems it proper, enter a judgment in favor of the Appellants-Appellants and against you in the agency appeal.
