NOTICE OF PUBLIC HEARING

Pursuant to Hawaii Revised Statutes (HRS) Chapter 91, notice is hereby given that the Hawaii Department of Transportation (HDOT) will hold a public hearing to hear all persons interested in the proposed new rules, Hawaii Administrative Rules Chapter 19-154, State Mileage-Based Road Usage Charge.

The purpose of the new rules is to support the implementation of a state
mileage-based road usage charge for drivers of electric vehicles (EV), starting on July 1, 2025. Upon the first registration renewal notice of an EV after July 1, 2025, the vehicle owner shall be offered a choice between the per-mile road usage charge ($8 per 1,000 miles driven, capped at $50) or the flat annual road usage charge of $50. The vehicle owner will pay their state mileage-based road usage charge at their annual vehicle registration. The state mileage-based road usage charge shall be calculated as the difference between the vehicle’s two most recent odometer readings, taken at their two most recent periodic motor vehicle inspections. Beginning July 1, 2028, all EV owners will be subject to the per-mile road usage charge. The key components of these new rules are:
General Provisions: Establishes the purpose of the state mileage-based road usage charge, defines key terms, and clarifies the scope of the rules.
Calculation of Road Usage Charge: Outlines how the state mileage- based road usage charge is determined using odometer readings from periodic motor vehicle inspections. Specifies calculations for new vehicles, including the initial registration process and first renewals.
Road Usage Charge Choice: Specifies the process for making the choice between the flat annual road usage charge and the per-mile road usage charge available to EV owners until June 30, 2028.
Out of State Permits: Clarifies that vehicles with out-of-state permits are subject to the state mileage-based road usage charge upon registration renewal and will maintain the same choice between the flat annual road usage charge and the per-mile road usage charge until June 30, 2028.
State Default Road Usage Charge: Establishes a state default road usage charge when there is insufficient odometer data to calculate a road usage charge: $50 until June 30, 2028 and $80 starting July 1, 2028.
Records and Reporting: Ensures collection of odometer data privacy follows state data retention policies.

Requests made as early as possible have a greater likelihood of being fulfilled.

The proposed amendments may be viewed and downloaded free of charge from

The proposed amendments may also be reviewed in person during regular business hours at Hawaii State Department of Transportation, 869 Punchbowl Street, Room 500, Honolulu, Hawaii 96813. A copy of the proposed amendments may be requested by mailing a request and money order for $4.75 to the address above. Checks should be made out to Hawaii Department of Transportation.
