NOTICE OF CONFIRMATION HEARING Com One, LLC v. Kona Hills, LLC, et al., Civil No. 3CCV-25-0000258 (KJ), Third Circuit Court, State of Hawaii. Fee simple agricultural properties and certain personal property and improvements on the properties, including but not limited to all improvements, equipment, water rights, leases, permanent plantings, crops, inventory, government program payments, insurance claims, condemnation awards, and rents. Lands situated in the County of Hawaii, State of Hawaii, identified by tax map key numbers: (3) 7-5-014-002, (3) 7-6-014-010, (3) 7-5-14-026, (3) 7-5-014-003, (3) 7-5-014-029(3) 8-1-002-040, (3) 8-2-012-012 and (3) 7-9-011-012, with a combined total land area of 1,983.373 acres. Jackson, Judge of the Circuit Court of the Third Circuit, State of Hawaii, located at Keahuolu Courthouse, 74-5451 Kamaka’eha Avenue, Courtroom 3B, Kailua-Kona, Hawai’i 96740. Interested parties may submit their bids at such time. TERMS OF SALE: Property will be sold in “AS IS” condition, without any express or implied warranties or representations of any kind, at public auction with 10% of the highest bid payable in certified or cashier’s check at the close of auction. The upset price is $12,600,000.00. Balance of highest bid shall be paid in full upon court approval and confirmation of sale. Potential bidders must be able to provide proof of their ability to comply with the 10% bid requirement BEFORE participating in the public auction. Purchaser shall pay ALL costs of closing, including, but not limited to, escrow fees, recordation fees, and conveyance taxes, and is responsible for securing possession of the Property upon escrow closing and recordation. The balance of the purchase shall be paid by certified or cashier’s check and is not subject to financing. Neither the availability of title insurance nor securing possession of the Property shall be conditions of sale closing. Sale closing shall occur not later than thirty-five (35) days after the entry of the order confirming sale.
