PUBLIC HEARING NOTICE
The State of Hawai’i Office of Information Practices (OIP) will hold a public hearing to consider the repeal of Hawaii Administrative Rules (HAR) Title 2, Office of the Lieutenant Governor, Subtitle 7, Office of Information Practices, Chapter 2-71 (HAR Chapter 2-71), which sets forth “Agency Procedures and Fees for Processing Government Record Requests” made under Hawaii’s Uniform Information Practices Act (UIPA), Chapter 92F, Hawaii Revised Statutes; and HAR Chapter 2-73, entitled “Administrative Appeal Procedures” (HAR Chapter 2-73); in their entirety and to be replaced by the proposed adoption of HAR Chapters 3-200 and 3-201, respectively.
OIP proposes to repeal the existing HAR Chapters 2-71 and 2-73 and renumber the rules to conform with the Department of Accounting and General Services (DAGS) administrative numbering system as effective July 1, 2016, OIP was administratively transferred from the Office of the Lieutenant Governor (LG) to DAGS. The proposed HAR Chapter 3-200, replacing HAR 2-71, also increases the search, review, and segregation fees for processing record requests to account for inflation, and creates a 100% fee waiver for requests that serve the public interest, provided that the waiver is not unduly burdensome for the agency. The proposed HAR Chapter 3-201, replacing HAR 2-73, also adds a severability clause. Both proposed chapters also include minor non-substantive edits such as correcting references to repealed statutes and other changes.
The public hearing will be held at the following date, time and place:
Date: December 1, 2026
