PUBLIC NOTICE (Docket No. 20-CA-PA-10) The Department of Health, State of Hawaii, is notifying all interested persons of the proposed settlement between the Department of Health and Edwin DeLuz Trucking&Gravel, LLC. The Department of Health has issued a Notice and Finding of Violation and Order, in Docket No. 18-CA-EO-01, alleging that Edwin DeLuz Trucking&Gravel, LLC, violated state air pollution laws, HRS §342B-11, HAR §11-60.1-2, Covered Source Permit (“CSP”) No. 0454-01-C by failing to construct and operate the plant in accordance to the CSP; failed to install, operate, and maintain the water pressure gauge; failed to maintain the water spray system in good operating condition; and failed to submit the annual fee within sixty (60) days after the end of the 2016 calendar year. In addition, for the Noncovered Source Permit (“NSP”) No. 0360-01-N, the permittee failed to utilize the diesel engine generator listed in the permit for the crushing and screening plant; and failed to maintain the water spray system in good operating condition. A Consent Order has been drafted that proposes to settle this case.
